1. Acceptance of Terms

By accessing or using Parkyng (the "Platform", "Service", "we", "us"), you agree to be bound by these Terms & Conditions (the "Terms"). If you do not agree, you must not use the Service. These Terms form a binding agreement between you and the operator of Parkyng, located at Avenue de Milly, 74500 Neuvecelle, France.

2. Definitions

• Platform — the Parkyng website and services available at parkyng.tech.
• User — any person or entity with a registered account.
• Buyer — a User searching for aircraft parking spots (e.g. airline, lessor, operator).
• Seller — a User offering aircraft parking spots (e.g. airport, MRO, facility operator).
• Listing — a parking spot posted by a Seller.
• Credit — a unit of pre-paid account balance used to unlock Seller contact details.
• RFQ — a Request for Quote submitted by a Buyer to a Seller through the Platform.

3. Account Registration & Eligibility

To use most features of the Platform, you must create an account. You represent that:

• You are at least 18 years old and have legal capacity to enter into contracts.
• You are registering on behalf of a legitimate business in the aviation industry.
• The information you provide is accurate, complete, and current.
• You use a business email address (personal email providers such as Gmail, Hotmail, Yahoo are not accepted).

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at contact@parkyng.tech of any unauthorized access.

4. Role of Parkyng — Marketplace Only

Parkyng is an online marketplace that connects Buyers and Sellers. We are not a party to any parking contract, transaction, or agreement between Users. We do not own, operate, manage, control, or maintain any parking facility listed on the Platform.

All contracts for parking services are formed directly between the Buyer and the Seller. Parkyng has no liability for the performance, non-performance, quality, legality, or safety of parking services transacted through the Platform.

5. Listings & Seller Responsibilities

Sellers are solely responsible for:

• The accuracy, completeness, and legality of their Listings (including location, pricing, availability, aircraft compatibility, PCN rating, and amenities).
• Holding all necessary licenses, permits, and authorizations to offer parking services.
• Responding to Buyer inquiries and RFQs in a timely manner.
• Honoring the terms described in their Listings and any agreements formed with Buyers.

Parkyng reserves the right to remove Listings that violate these Terms, contain false or misleading information, or are otherwise inappropriate, at our sole discretion and without prior notice.

6. Buyer Responsibilities

Buyers are solely responsible for:

• Independently verifying the suitability, accuracy, and availability of any Listing before entering into any agreement with a Seller.
• Conducting appropriate due diligence, including verifying Seller credentials, insurance, and regulatory compliance.
• Negotiating and executing any parking agreement directly with the Seller.
• All payments, liabilities, and obligations arising from such agreements.

7. Credits & Payments

Certain features of the Platform — notably unlocking Seller contact details — require the use of Credits. Credits are purchased through our payment processor (Stripe) in pre-paid packs.

• Pricing — credit pack prices are displayed in EUR (or your selected currency) at checkout.
• Non-refundable once used — Credits that have been consumed to unlock a Seller contact or perform any other paid action are non-refundable, as the service has been rendered and cannot be reversed.
• Unused credits — unused Credits remain available in your account balance. Refund requests for unused Credits may be considered on a case-by-case basis within 14 days of purchase, in accordance with applicable EU consumer law.
• No expiry — Credits do not expire unless the account is closed or terminated.
• Taxes — prices may be exclusive of VAT. Applicable taxes will be displayed at checkout.

All payments are processed by Stripe. We do not store your full payment card details on our servers.

8. Contact Unlock & RFQs

When you use a Credit to unlock a Seller's contact details, the information is revealed to you within the Platform. You agree to use this information only for legitimate business purposes related to sourcing aircraft parking.

You must not harvest, scrape, resell, or distribute Seller contact information to third parties, or use it for marketing, solicitation, or other purposes unrelated to the Listing.

9. Prohibited Uses

You agree not to:

• Use the Platform for any illegal, fraudulent, or unauthorized purpose.
• Post false, misleading, defamatory, or infringing content.
• Impersonate any person or entity, or misrepresent your affiliation.
• Attempt to gain unauthorized access to the Platform, other accounts, or our systems.
• Use automated means (bots, scrapers, crawlers) to access the Platform without prior written consent.
• Interfere with or disrupt the Platform or servers.
• Circumvent the Credit system, for example by sharing unlocked contact information with other Users.
• Use the Platform to compete with Parkyng or to build a competing service.

10. Intellectual Property

The Platform, its design, code, trademarks, and content (excluding User-submitted content) are owned by Parkyng and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose. You retain ownership of content you submit (such as Listings) but grant us a worldwide, royalty-free license to display, distribute, and promote that content on the Platform and related channels.

11. Disclaimers

The Platform is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses. We do not warrant the accuracy, completeness, or reliability of any Listing or User-submitted content.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Parkyng and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Platform or any transaction between Users.

Our total aggregate liability for any claim arising out of these Terms or your use of the Platform shall not exceed the total amount you paid to Parkyng in the twelve (12) months preceding the claim, or one hundred euros (€100), whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless Parkyng and its operators from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of your use of the Platform, your violation of these Terms, your violation of any rights of a third party, or any agreement you enter into with another User.

14. Suspension & Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or abusive behavior, or created risk or legal exposure for Parkyng or other Users.

You may close your account at any time from your profile page. Unused Credits may be eligible for refund as described in Section 7. Data deletion is governed by our Privacy Policy.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be notified to you by email or by a notice on the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of France, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms or your use of the Platform shall be submitted to the exclusive jurisdiction of the competent courts of France, without prejudice to any mandatory consumer protection provisions applicable in your country of residence.
